Terms & Conditions
FIREPLACE SERVICE MEMBERSHIP
Terms & Conditions
Effective Date: September 23, 2026
Company: Inside and Out LLC (“Company,” “we,” “us,” or “our”)
These Fireplace Service Membership Terms & Conditions (“Agreement”) govern participation in the Company's Fireplace Service Membership Program (“Membership”). By purchasing a Membership, the customer (“Customer,” “you,” or “your”) acknowledges that they have read, understood, and agree to all terms and conditions contained in this Agreement.
1. MEMBERSHIP PLANS & SERVICE AREAS
Membership pricing is based on the physical location of the fireplace or appliance being serviced. The Customer's billing or mailing address does not determine the applicable Membership tier.
The available service areas are:
CLOSE TO THE HEARTH
Within a 30-mile radius of the Company's service location.
THE LONG BURN
More than 30 miles and up to 50 miles from the Company's service location.
THE DISTANT FLAME
More than 50 miles and up to 80 miles from the Company's service location.
SPECIALTY SERVICE AREA
Service addresses located more than 80 miles from the Company's service location may be eligible for Membership at specialty pricing. Specialty pricing will be determined based on the service location and circumstances and will be communicated to the Customer before enrollment.
The Company reserves the right to verify the service address and determine the appropriate Membership tier. If a Customer enrolls in a Membership tier that does not correspond to their service address, the Company may require the Customer to change to the appropriate tier before providing service.
2. MEMBERSHIP BILLING & PAYMENT
All Membership payments and recurring billing will be processed through Squarespace and its applicable payment processing services.
Memberships are available in different payment periods. The minimum billing period that may be selected is three (3) months.
Membership pricing is discounted according to the selected commitment period:
-
3-month Membership: Standard Membership pricing
-
6-month Membership: 5% discount
-
12-month Membership: 10% discount
The applicable discount is based on the selected Membership period.
By enrolling in the Membership, Customer authorizes recurring charges through Squarespace for the selected Membership period.
Customer is responsible for maintaining a valid payment method throughout the Membership.
We reserve the right to change our pricing at any time. Notice will be provided.
3. MINIMUM THREE-MONTH COMMITMENT
All Memberships require a minimum commitment of three (3) months.
The Customer agrees to pay for at least three months of Membership regardless of whether the Customer requests or uses a service call during that period.
Memberships may not be canceled during the initial three-month commitment period in order to avoid payment of the required three months.
4. NO REFUNDS
Membership payments are non-refundable.
No refunds will be issued for unused portions of a Membership period, including situations in which the Customer does not request or use a service call.
The Company does not provide prorated refunds for cancellations, unused service calls, or unused Membership time.
5. WHAT THE MEMBERSHIP INCLUDES
The Membership fee covers the Company's service visit for:
-
Inspection
-
Diagnosis
-
Cleaning
The Membership is intended to provide the Customer with convenient access to routine fireplace service while helping maintain the fireplace and identify potential issues.
The cost of parts, replacement components, materials, or equipment is not included in the Membership price.
If replacement parts or materials are necessary, those items will be charged separately to the Customer.
6. UNLIMITED SERVICE CALLS
The Membership provides access to what is referred to as “unlimited service calls,” subject to the following limitation:
Membership service is limited to a maximum of twelve (12) service calls per twelve-month period, or approximately one (1) service call per month.
The term “unlimited service calls” therefore means that the Customer may request covered service as needed throughout the Membership period, up to the maximum of twelve (12) covered service calls per twelve-month period.
Service calls do not accumulate or roll over from one Membership period to another.
The Membership does not guarantee that every requested service will be covered. Services outside the scope of the Membership, including work requiring additional labor, materials, parts, specialized services, or other work not included in the Membership, may be subject to additional charges.
7. ADDITIONAL LABOR, MATERIALS & SPECIALTY SERVICES
The Membership price covers the inspection, diagnosis, and cleaning services described in this Agreement.
If the Company determines that a requested service:
-
Requires substantial additional labor;
-
Requires materials or parts;
-
Requires specialized equipment;
-
Requires work outside the normal scope of the Membership;
-
Is outside the Customer's applicable service area; or
-
Otherwise requires additional charges,
the Company will notify the Customer before performing the additional work whenever reasonably possible.
When applicable, the Company will provide the Customer with an estimate for the additional work before proceeding.
Customer approval will be required before additional chargeable work is performed, unless otherwise agreed upon.
8. EMERGENCY RESPONSE ADD-ON
Customers may elect to purchase an optional Emergency Response Add-On for $10 per month.
The Emergency Response Add-On provides a target response time of 48 business hours when the Customer's fireplace suddenly stops working.
“48 business hours” means that the response period is calculated using the Company's normal business hours and does not include weekends, holidays, or other days when the Company is closed.
The Emergency Response Add-On provides a response within the stated timeframe; it does not guarantee that the fireplace will be repaired within that timeframe.
Parts, materials, extensive repairs, and work outside the standard Membership remain subject to additional charges.
The Emergency Response Add-On does not eliminate the Company's ability to postpone or reschedule service due to circumstances outside the Company's reasonable control.
9. ANNUAL MAINTENANCE & OFF-SEASON SCHEDULING
Annual maintenance service should be scheduled during the Company's off-season maintenance period of March through July.
Customers are responsible for contacting the Company and scheduling their own service appointment.
The Company may contact Members during the off-season months to remind them about general maintenance and encourage them to schedule their annual service.
While the Company may provide reminders, the Customer remains responsible for scheduling their service appointment.
10. SERVICE SCHEDULING & AVAILABILITY
Membership does not guarantee immediate, same-day, or after-hours service unless the Customer has purchased the Emergency Response Add-On and the request qualifies under the terms of that Add-On.
All standard service calls must be scheduled with the Company.
Appointments are subject to technician availability, business hours, service-area requirements, and other scheduling considerations.
The Company will make reasonable efforts to accommodate Membership service requests but does not guarantee a particular appointment date or time.
11. PRE-EXISTING CONDITIONS
The Company is not responsible for pre-existing conditions, defects, damage, or problems that existed before the Company's technician arrived at the property.
This includes, but is not limited to, pre-existing issues involving:
-
Masonry;
-
Chimneys;
-
Venting systems;
-
Flue systems;
-
Fireplaces;
-
Inserts;
-
Stoves;
-
Surrounding structures;
-
Previous installations;
-
Previous repairs or modifications; or
-
Other conditions existing before the Company's service visit.
The Company's inspection or cleaning of an appliance or system does not constitute a guarantee that all pre-existing conditions have been identified or corrected.
If the Company identifies a pre-existing condition that requires additional work, the Company may notify the Customer and provide an estimate for the necessary work.
12. CUSTOMER RESPONSIBILITIES
The Customer is responsible for:
-
Providing accurate information regarding the fireplace, appliance, and service address.
-
Providing reasonable and safe access to the fireplace and related equipment.
-
Scheduling their own service appointments.
-
Maintaining a valid payment method.
-
Paying for parts, materials, and services not included in the Membership.
-
Informing the Company of known problems, previous repairs, modifications, or other relevant conditions.
-
Following reasonable manufacturer recommendations and operating instructions.
The Customer must ensure that the Company and its technicians can safely access the equipment and perform the requested service.
13. CIRCUMSTANCES OUTSIDE THE COMPANY'S CONTROL
The Company is not responsible for delays, cancellations, inability to perform service, or inability to meet an expected response time when caused by circumstances outside the Company's reasonable control.
Such circumstances may include, but are not limited to:
-
Severe weather;
-
Snow, ice, flooding, or unsafe road conditions;
-
Road closures;
-
Natural disasters;
-
Power outages or utility interruptions;
-
Emergencies;
-
Acts of third parties;
-
Equipment or parts availability;
-
Manufacturer or supplier delays;
-
Government restrictions;
-
Unsafe property conditions; or
-
Other circumstances beyond the Company's reasonable control.
When such circumstances occur, the Company will make reasonable efforts to reschedule or provide service when conditions permit.
14. PAYMENT FAILURE
If a scheduled Membership payment fails, is declined, or cannot otherwise be processed through Squarespace, the Company may attempt to collect the outstanding amount using the payment information provided by the Customer.
If the Customer's payment method cannot be successfully charged, the Company may invoice the Customer for the remaining balance of their applicable Membership commitment.
Failure to pay an outstanding balance may result in suspension or termination of Membership benefits.
Customer remains responsible for amounts owed under this Agreement regardless of whether the Customer continues to use Membership services.
15. MEMBERSHIP SUSPENSION OR TERMINATION
The Company may suspend or terminate a Membership when permitted under this Agreement, including in situations involving:
-
Failure to pay;
-
A failed or invalid payment method;
-
Violation of these Terms & Conditions;
-
Misrepresentation of the service address;
-
Abuse or misuse of Membership benefits;
-
Unsafe conditions;
-
Threatening, abusive, or inappropriate behavior toward Company personnel; or
-
Other circumstances that reasonably prevent the Company from continuing to provide Membership services.
Termination or suspension does not eliminate Customer's responsibility for amounts already owed.
16. MEMBERSHIP DOES NOT GUARANTEE EQUIPMENT PERFORMANCE
Membership enrollment does not guarantee that a fireplace, stove, insert, chimney, venting system, or other equipment will remain operational or free from future problems.
The Membership is a service program and is not an insurance policy, equipment warranty, or guarantee against equipment failure.
The Company does not guarantee that an inspection, diagnosis, or cleaning will prevent future repairs, breakdowns, damage, or other issues.
17. SAFETY & RIGHT TO DECLINE SERVICE
The Company reserves the right to decline, postpone, or discontinue service if a technician determines that conditions are unsafe or that performing the requested work could create an unreasonable risk to the technician, Customer, property, or equipment.
If additional work is necessary to make the situation safe or to allow the requested service to be performed, the Company may provide the Customer with an estimate for that work.
18. SERVICE AREA & SPECIALTY PRICING
Membership pricing is specifically based on the Customer's service location.
If the Company determines that a service location is outside the standard 80-mile service area, the Company may offer specialty pricing based on the specific location and circumstances.
Specialty pricing must be agreed upon before Membership enrollment.
The Company reserves the right to decline Membership service at locations where providing service is not reasonably practical.
19. CHANGES TO MEMBERSHIP TERMS
The Company reserves the right to modify Membership pricing, benefits, service areas, or other program terms for future Membership periods.
Any changes to an existing Customer's Membership will be communicated in accordance with applicable law and the terms of the Customer's existing commitment.
